General terms for using a public or guest Wi-Fi network and its captive portal.

Parties, scope and acceptance

These terms apply when they are presented or linked on a public or guest Wi-Fi captive portal. The particulars for each deployment are:

Venue
The premises identified on the captive portal or network signage
Venue Operator
The owner, manager or operator identified on the captive portal
Wi-Fi Provider
The entity identified on the captive portal as providing or operating the Wi-Fi service
Effective date
The date or version displayed on the captive portal
Support contact
The contact details displayed on the captive portal or venue signage

In these terms, the Venue Operator and Wi-Fi Provider are together referred to as the “Service Parties”. “Portal” means the captive portal used to register, sign in or obtain access, “Network” means the venue Wi-Fi network, and “Service” means access to the Network and related portal functionality.

By selecting the acceptance option, registering, signing in or using the Service, you confirm that you have read and agree to these terms. If you do not agree, do not use the Service.

You confirm that you are at least 18 years old and have legal capacity to accept these terms. If the Portal expressly permits use by a person under 18, that person must use the Service with the involvement and permission of a parent or legal guardian.

Important consumer notice

Clauses dealing with security, availability, suspension, liability and indemnity may limit the risk or liability of a Service Party, require you to assume risk, or require you to indemnify another person. Please read those clauses carefully. Nothing in these terms excludes a right or remedy that cannot lawfully be excluded under the Consumer Protection Act, 2008 or another applicable law.

Access to the Service

  • You need a compatible Wi-Fi device and must complete any registration, verification or acceptance steps shown on the Portal.
  • The Service is supplied for personal, temporary internet access at the Venue. It does not create a permanent right of access.
  • Any time, speed, data-volume, device or session limits shown on the Portal form part of these terms.
  • You are responsible for information submitted through your device and for keeping any login credentials or verification codes confidential.
  • The Service Parties may apply reasonable traffic management, filtering, session limits or throttling to protect users, maintain performance, comply with law or manage excessive use.

Acceptable use

You must use the Service lawfully and must not use or attempt to use it to:

  • access, distribute, store or transmit unlawful, fraudulent, abusive, threatening, defamatory, infringing or harmful material;
  • infringe another person's privacy, confidentiality, intellectual property or other rights;
  • gain unauthorised access to a device, account, network, system or data, including by hacking, password mining, scanning or interception;
  • introduce malware, viruses, ransomware, malicious code or any technology intended to damage, disrupt or compromise a device or system;
  • send spam, conduct phishing, impersonate another person or conceal the origin of unlawful activity;
  • operate a server, provide network services, resell access or share access commercially without prior written permission;
  • use automated, repetitive or resource-intensive processes that unreasonably affect the Network or other users; or
  • circumvent a security control, content filter, usage limit, suspension or access restriction.

You remain responsible for activity initiated through your device or credentials. The Service Parties may investigate suspected misuse and may preserve or disclose relevant records where required or permitted by law.

Network security, management and suspension

Public Wi-Fi is not inherently secure. You should use encrypted websites and services, keep software updated, use appropriate security tools and avoid transmitting highly sensitive information over an untrusted connection. The Service Parties do not provide security software for your device and cannot guarantee that the Network will be free from interception, malware or unauthorised access.

To operate, secure and protect the Service, the Service Parties and their technical providers may collect network logs, detect threats, apply filters, inspect traffic metadata and take other proportionate network-management measures. This does not authorise access to the contents of encrypted communications. Personal information generated by these activities is handled under the applicable privacy notice and law.

Access may be restricted, suspended or terminated without prior notice where reasonably necessary to address misuse, security or legal risk, protect other users, perform maintenance, comply with a lawful instruction or enforce these terms. Where appropriate, access may be restored after the relevant risk or breach has been resolved.

The external Fatti Trust Centre provides non-contractual public assurance information about the standard architecture, security and resilience approach. Deployment-specific controls remain subject to the applicable service scope and agreement.

Privacy and communications

The Wi-Fi captive portal privacy notice, together with any shorter venue-specific notice displayed on the Portal, explains how registration details, device and network information, portal activity and venue analytics may be handled.

Acceptance of these service terms is not, by itself, consent to optional direct marketing or disclosure of identifiable information for another organisation's marketing. Any consent required for those activities should be presented separately on the Portal and may be withdrawn as explained in the privacy notice.

Operational messages needed to register, authenticate, secure or administer the Service may still be sent where permitted by law.

Availability, warranties and liability

The Service is provided on an “as available” basis. Network coverage, speed, compatibility, security and uninterrupted access are not guaranteed. The Service may be affected by maintenance, capacity, interference, power or telecommunications failures, third-party systems and circumstances outside the Service Parties' reasonable control.

To the fullest extent permitted by law, the Service Parties do not warrant that the Service or content reached through it will always be available, accurate, secure, error-free or suitable for a particular purpose. You are responsible for deciding whether the Service is appropriate for your intended activity and for maintaining backups of important data.

Nothing in these terms excludes or limits liability where doing so would be unlawful. Subject to that qualification, a Service Party will not be liable for indirect, special or consequential loss, loss of profit, business interruption, loss of data, or damage arising from third-party content, your device security, prohibited use, or events outside its reasonable control.

You agree to be responsible for loss or claims reasonably arising from your unlawful use of the Service, your material breach of these terms, or your infringement of another person's rights. This obligation does not apply to the extent that the loss was caused by a Service Party's unlawful conduct, gross negligence or other conduct for which liability cannot lawfully be limited.

Third-party services and portal content

The Service provides access to the internet and may display links, promotions or services supplied by third parties. Those parties operate independently and may have their own terms and privacy notices. A link or facilitated connection does not amount to a warranty or endorsement of a third party, its content, products or services.

Portal software, branding, text, graphics and other materials are owned by or licensed to the relevant Service Party. You may use them only as needed to access the Service. You may not copy, modify, distribute, reverse engineer or commercially exploit them except where the law expressly permits it.

Changes, law and contact

These terms may be updated to reflect changes to the Service, security requirements or law. The version presented when you connect applies to that session unless the Portal states otherwise. If a material change requires renewed acceptance, the Portal will request it.

These terms are governed by the law identified on the Portal or, if no jurisdiction is identified, the law of the country in which the Venue is located. A court or tribunal with jurisdiction under applicable law may hear a dispute. If one provision is invalid or unenforceable, the remaining provisions continue to apply.
